المراد بالنص في قاعدة " لا اجتهاد مع النص"

ملخص البحث
تناول هذا البحث بعامة قاعدة "لا اجتهاد مع النص" فبين معناها،وصيغها، وأدلتها، وأهميتها في ضبط الاجتهاد، ودورها في تحديد ما يجوز الاجتهاد فيه، وما لايجوز،كماتناول التعريف بالاجتهاد، وأنواعه، والمراد به في القاعدة، وحكمه، ثم تناول مفهوم النص، فبين معناه لغة، وعرض لإطلاقاته في كتب التراث بعامة، ثم عرض لمفهومه عند أصولي الحنفية،وأصولي المتكلمين، وعند الفقهاء بخاصة،كما حدد المراد بقطعية النص في القاعدة، حسب الواقع التراثي.
وقد انتهى البحث إلى أن المراد بالنص في القاعدة هو النص بمصطلح الفقهاء، وليس بمصطلح جمهور الأصوليين من المتكلمين، وهو عند الفقهاء لا يختص بقطعي الثبوت والدلالة،وإنما يطلق على كلام الوحيين، سواء كان قطعياً في الدلالة أو ظاهراً، أو مؤلاً، ترجح بدليل معتبر، فهو عندهم في مقابل القياس،والمصلحة، والإجماع، والاستنباط، والعرف، وعموم أدلة المعقول، فكان المقصود بالقاعدة عندهم أنه "لا اجتهادفي مقابل النص الصحيح الثبوت، بجميع مدلولاته، قوية الظهور"، وليس المراد "لا اجتهاد في مقابلة النص قطعي الثبوت والدلالة  فقط، كما يتوهم" .
Abstract:
This research dealt with the rule (no diligence –ijtihad- with the text) in general, so it clarified its meaning, formulas, evidence and importance in controlling diligence, and its role in determining what is permissible and what is not permissible. He clarified its meaning in language, and presented its releases and idiomatic uses in heritage books in general Then he presented its concept according to the Hanafi fundamentalists and the fundamentalists of the theologians, and among the jurists, as it specified what is meant by the categorical text in the rule according to the heritage reality. With definitive proof and evidence, but it is applied to the speech of the two revelations, whether it is definitive in terms of evidence or apparent, or probable and outweighed by considered evidence, For them, it is in contrast to analogy, consensus, deduction, and the generality of reasonable evidence, so the rule was meant that (there is no diligence –ijtihad- in contrast to the correct text with all its strong apparent meanings), and not (there is no diligence –ijtihad- in contrast to the text that is definitive proof and evidence only as it is delusional).
